1. General Terms
1.1. The bylaw on the investment projects support under the “One-Stop Shop” principle in Rostov region (hereinafter – Bylaw) establishes the mechanisms of collaboration among Rostov region executive government authorities, organs of local self‑government of Rostov region municipal units, and the subjects of the investment activities when implementing investment projects in the territory of Rostov region.
1.2. The concept of “One-Stop Shop” support presupposes the support of investment projects on the part of Rostov region executive government authorities, organs of local self‑government of Rostov region municipal units in accordance with the unified principle of cooperation with investors in Rostov region.
1.3. This Bylaw was developed in accordance with the Regional Law of 01.10.2004 № 151-ЗC “On the Investments in Rostov Region”, the annual Rostov region Governor message “The Investment Climate and Investment Policy of Rostov region”, and the Enactment of the Government of Rostov region of 05.07.2012 № 578 “On the mechanism of formation and maintaining the Register of investment projects in Rostov region”.
1.4. The objective of this Bylaw is to establish the mechanism of the implementation process for investment projects in Rostov region.
1.5. For the purposes of the current Bylaw the following expressions are used:
- subjects of investment activity - are participants of the investment process, which can be either Russian or foreign investors, clients, subcontractors, users of the investment objects, infrastructure organizations (consulting, investment, insurance, credit and financial companies) and others;
- investor – is a subject of investment activity accomplishing investments of the proprietary, borrowed or raised funds and guaranteeing their intended use. Private individuals, legal entities, including business entities operating in the mining territories of Rostov region, foreign business entities, state bodies of the Russian Federation and Rostov region, municipal authorities and international organizations can function as investors.
- objects of investment activity – are newly created or modernized property irrespective of the proprietary form, securities, R&D products, other types of property, as well as property rights and intellectual property rights except for the cases defined by the federal laws;
- investment project – is an explanation of economic feasibility, volumes and timelines of investment phases, including design estimation paperwork elaborated and approved in accordance with the federal and regional legislation, as well as the description of practical moves of the investment process (a business plan).
2. Vehicles of the investment process organization
2.1. In accordance with Enactment of the Government of Rostov region of 09.12.2011 № 217 “On the Regulation of the Department of Investments and Entrepreneurship of Rostov region” the Department of Investments and Entrepreneurship of Rostov region (hereinafter – the Department) exercises the functions of developing investment activity and implementing investment policy in Rostov region. If it is necessary the Department cooperates with the executive government authorities of Rostov region, institutions, infrastructure facilities (funds, agencies, etc).
2.2. The investment procedure in the territory of Rostov region is organized with the help of the following bodies:
2.2.1. The Ministry of Economic Development of Rostov region together with the industry-specific regional ministries elaborates the forecast of investment activity for the short-term, medium-term and long-term periods with regard to the information from the Agency for Investments and Development of Rostov region (hereinafter – the Agency) about the potential investment projects.
2.2.2. The Ministry of Construction, Architecture and Territorial Development of Rostov region:
elaborates and makes proposals in an established order to the Ministry of Economic Development of Rostov region concerning the formation of regional investment programs in the sphere of construction, architecture and city planning, construction industry and building materials industry of Rostov region; concerning the inclusion into the federal target programs the important objects of territorial and town planning, capital construction of regional property and residential buildings;
makes proposals to the local self-governing bodies of the municipal units of Rostov region about introducing changes into the land-use planning documents of the municipal units of Rostov region;
makes proposals to the local self-governing bodies of the city districts and settlements of Rostov region about introducing changes into the master plans of the city districts and settlements of Rostov region (parts of the city districts and settlements);
makes proposals to the federal executive authorities, executive authorities of the entities of the Russian Federation, local self-governing bodies about the co-operative preparation of the land-use planning documents;
exercises the powers to form and coordinate the development of engineering and transportation infrastructure in the settlement system of Rostov region;
prepares and approves the land-use planning schemes of Rostov region, planning documents in case if the land-use planning scheme of Rostov region presupposes the localization of linear objects of regional importance;
prepares the projects of the Rostov region governmental enactments on reserving land for the state needs of Rostov region.
2.2.3. The Ministry of Property and Land Relations, Financial Reconstruction of Enterprises and Institutes of Rostov region:
manages and commands the property and land sites in the state ownership of Rostov region;
prepares together with the interested executive authorities and local self-governing bodies the documents about land transfer from one category into another concerning lands and land sites in the state ownership of Rostov region, lands and land sites whose state ownership is not divided and agriculture lands and land sites in the municipal or private property.
2.2.4. The Ministry of Housing and Public Utilities of Rostov region:
exercises the functions of implementing the state policy in the sphere of housing and public utilities, construction, reconstruction and use of infrastructure objects as well as coordinating and regulating supervised spheres of economy and administration;
monitors the condition of engineering infrastructure and the situations which can lead to malfunction of life-supporting systems, as well as the elimination of their consequences within the competence of the Ministry;
takes part in the review of programs of complex development of public utilities systems in the municipal units of Rostov region approved by the local self-governing bodies in accordance with the land planning documents of the municipal units, and investment programs of public utilities complex organizations for public utilities infrastructure development.
2.2.5. The Ministry of Industry and Energy of Rostov region:
coordinates the localization of electric power facilities in the territory of Rostov region;
evaluates investment programs of electric power suppliers with regard to:
conformation of an investment program to the electric power development program of Rostov region for the next 5 years;
localization and date of putting electric power facilities into operation in the territory of Rostov region;
coordination of local grid companies investment programs of power distribution network development with the investment program of Federal Grid Company of Unified Power System OJSC and the development program of Unified Energy System of Russia as well as investment programs of co-joint grid companies;
coordinates investments programs of grid companies with the development programs of generating capacities in Rostov region;
supervises the execution of the investment programs approved by the Regional Tariff Service of Rostov region where it concerns the implementation of physical quantities (launch of facilities, kilometers of lines, MVA capacities), construction works schedule (execution of works) item-by-item;
takes parts in the supervision of investment programs implementation of electric power subjects referred to the range of subjects whose investment programs are approved by the Ministry of Energy of the Russian Federation;
organizes the elaboration and implementation of the regional programs in the sphere of energy saving and energy efficiency improvement.
2.2.6. The Ministry of Agriculture and Food of Rostov region:
elaborates and implements regional long-term target and departmental target programs of the main directions of agriculture and food policy, location and development of agriculture industries, food and processing industry (except alcohol and tobacco), production of agriculture and food products, social and engineering infrastructure development of rural territories, development of livestock breeding and small forms of business;
elaborates and prepares conclusions about the practicality of purchasing land sites of agricultural use into the state ownership of Rostov region.
2.2.7. The Ministry of Transport of Rostov region:
coordinates and prepares the division and purchase of land for construction and reconstruction of auto roads of regional and intermunicipal importance and road infrastructure facilities, demolition and transfer of buildings and public utilities;
implements potential and current planning of road network development of regional and intermunicipal importance, and sets up annual work schedule in the sphere of regional public road system;
elaborates a mobilization plan in the specified sphere of activity as well as manages the creation and saving of mobilization capacities in the subordinate state unitary entities;
in an established order issues permits for construction, reconstruction and putting into operation of auto roads of regional and intermunicipal importance as well as construction and reconstruction of private roads which are planned to be built in the territory of two or more municipal units (municipal districts, city districts, etc).
2.2.8. The Department of Investments and Entrepreneurship of Rostov region:
elaborates and implements measures for the development of investment and innovation activity in order to attract domestic and foreign investments, support investment and innovation activity in the region on the part of the state, promote demonopolization and develop competition in Rostov region;
takes part in the elaboration and implementation of measures of efficient use of the budget intended for capital investments; supports businesses and individual entrepreneurs; conducts the analysis of the efficiency of the granted state support;
analyzes processes of innovation and investment activities, small and medium-size entrepreneurship and tourism; singles out certain tendencies and priorities, disproportions and ways to eliminate them;
organizes interregional cooperation in the sphere of innovation and investment activity, development of small and medium-size entrepreneurship and tourism;
- provides assistance in the implementation of municipal programs for development of small and medium-size businesses, tourism and investment activity.
2.2.9. Rostov region Tariff Service sets costs for the technological connection to the power networks of the local power grid companies and/or standard tariff rates which determine the size of the cost.
2.2.10. According to the Federal law of 06.10.2003 №131 “On the common principles of organization of self-government in the Russian Federation” municipal self-government bodies of Rostov region perform the following functions:
devise and implement investment policy of the municipal unit for the short-, middle- and long-term periods;
elaborate and implement investment programs for the development of the municipal engineering infrastructure;
elaborate programs for attracting investments;
monitor land plots suitable for investment projects localization;
form land plots intended for investment projects localization.
2.2.11. Agency for Investments and Development of Rostov region is an organization with which a government contract is concluded by tender. It is supposed to organize the investment process in Rostov region and attract investments into the territory (hereinafter – Agency).
According to the government contract for organization of the investment process in Rostov region and attraction of investments, the Agency can be entitled with the following rights and obligations:
prepare suggestions for creating favourable economic conditions for manufacturing, investment, innovative activities, and development of entrepreneurship;
elaborate and exercise measures for attracting domestic and foreign investments;
form the data base investment and innovation proposals, including the small business sector;
assist in the investment projects evaluation according to the Russian Federation legislation;
form and maintain the investment projects register of Rostov region;
elaborate possible ways to develop the infrastructure of the investment market;
assist in attracting investors for the significant projects of Rostov region;
elaborate measures to stabilize social and economic development of problematic territories;
prepare analytic and informational materials on the investment potential and investment climate of Rostov region;
elaborate and implement the investment marketing program;
provide organizational support of investors in Rostov region;
conduct the analysis of financial market, prepare suggestions how to attract non-budget investments in the prioritized industries and economy sectors;
other rights and obligations specified in the government contract for organization of the investment process in Rostov region and attraction of investments.
3. The order of the investors’ applications processing
3.1. The grounds for the start of the investment project support is the receipt of the investor’s application to obtain the full-service support of the investment project addressed to the executive government authorities of Rostov region, local self‑government organs of municipal units, or the Agency.
The time limit for application processing is set according to the Federal Law of 02.05.2006 № 59-ФЗ “On the order of processing the applications of the Russian Federation citizens”, which cannot exceed 30 days limit.
3.2. The investor application must contain the following information:
general information about the investor, initiator of the project (the form of incorporation, name of the company, actual address);
brief description of the investment project (including the volume of investment, number of jobs to be created, approximate timeline of project implementation);
information of a contact person (initiator of the project).
3.3. The application can be sent by the investor:
- in electronic format by filling out the form found on the official investment website of Rostov region (www.invest-dom.com);
- via E-mail;
- in hard copy.
3.4. The Department forwards the information on the investment project to the relating executive governmental body of Rostov region.
3.5. The support of investment projects is carried out within the working scope of the industry-specific working groups of the executive bodies of Rostov region (hereinafter – Working groups), municipal investment councils (which make a conclusion on the economic feasibility of investment projects in Rostov region that is then sent to Department).
3.6. After reviewing the information on the investment projects at the sessions of industry-specific working groups, Rostov region municipal units send it to the Department for it to be included in the Register of investment projects (hereinafter – the Register), which is a one whole informational system with a data base of the investment projects implemented in Rostov region posted on the investment website of Rostov region (www.invest-don.com).
3.7. The procedure of inclusion in the Register is regulated by the Enactment of the Government of Rostov region of 05.07.2012 №578 “On the mechanism of formation and maintaining the Register of investment projects in Rostov region”.
3.8. The information on the processed investment projects to be implemented in Rostov region is also posted on the investment website of Rostov region (www.invest-don.com).
3.9. Investment projects which do not conform to the terms of the Enactment of the Government of Rostov region of 05.07.2012 №578 are to be sent back to the investor (initiator of the investment project) for revision.
3.10. Support of investment projects includes assistance in the following types of activities:
timely receipt by the investor of the necessary approvals and permissions in the governmental bodies and local organs of self-governance in Rostov region;
timely receipt by the investor of technical specifications for the connection to engineering infrastructure networks;
other types of assistance reducing the implementation period of the project.
Support of the investment projects which are being implemented or are to be implemented in the territory of Rostov region may be carried out in a form of providing the investor with consulting, informational, legal, administrative and organizational assistance which helps attract funds for the implementation of the investment project from investment and venture funds, angel investors, development institutions, private investors, financial institutions.
If needed, the industry-specific executive bodies initiate the supervision process of the implementation of the investment projects at the sessions of the Rostov region gubernatorial investment councils.
3.11. After being reviewed at the sessions of the industry-specific working groups and municipal investment councils, investors’ applications which are to be processed within 30 days, are then to be reviewed at the gubernatorial investment councils, including a presentation of the investment project, if necessary. By the decision of the gubernatorial investment council members, investment projects presented at the sessions of the council are forwarded to the Governor of Rostov region and are included in the list of “100 Gubernatorial investment projects”.
